» Nintendo Responds To Wii Controller Strap Lawsuit

Nintendo has officially responded to Tuesday's class action lawsuit concerning their controller wrist strap for their Wii console. The lawsuit claims the original version of the strap caused the controller to be defective. Here is Nintendo's official response:

We believe the lawsuit to be completely without merit. Nintendo has a long tradition of delivering high-quality products and excellent customer service, and we take all reports from our customers seriously.

At the time we became aware of the lawsuit, we had already taken appropriate steps to reinforce with consumers the proper use of the Wii Remote and had made stronger replacement wrist straps available. This suit has had no effect on those efforts.

Would people still try suing them if the wrist straps weren't even there? People who blame their own stupidity on others really makes me angry. Good on Nintendo for not backing down. Well, not much anyway, they have offered the replacement straps, obviously this isn't enough for some people.

So if I take my digital camara and try throwing it like a baseball and the wrist strap breaks can I sue Canon?

Wrist straps are made to prevent you from on acident dropping the product. Not to protect against people throwing the product so really the wrist strap works as intended.

Dude... Don't make comments when you have no idea what you are talking about. The wii manual specifically says the wii straps are to prevent the wiimote from leaving your hand while swinging it. They are not to prevent you from "dropping" it. They are to prevent you from throwing your wiimote through your TV. If any of these people were properly using the wii strap and it broke and went through their TV or injured someone they have a right to sue. Though I don't think they should because Nintendo made very quick adjustments to their wii straps and strongly encourage proper use of the wii strap in every game they produce.

No sir you are wrong, you are NOT supposed to let go of the Wiimote in the first place. That is the only way the Wiistrap would have experienced such forces.

Nintendo had many warnings telling you to hold the Wiimote securely and NOT let go. If you let go of the controller and swing the thing hard enough of course the Wiistrap will eventually break.

Admittedly the straps should be tougher to break and there needs to be an investigation regarding exactly how much force the Wiistraps can withstand. IF it is found that normal usage can cause failures then Nintendo is liable (this does not take into account those hurling Wiimotes are 100mph - i mean normal use), If normal usage does not cause failure then this should be dropped.

It seems inconceivable that the wrist straps would break during what's considered normal usage, simply because normal usage implies that one is holding the remote with their hands, and that little if any tension should be felt by the wrist strap in the first place.

The strap seems more than capable of withstanding accidental slips of the remote when playing, which IMO shouldn't happen very often. I certainly wouldn't champion letting a $40 piece of equipment fly around with a chance to smash into something.

Another American wanting to get rich by suing a big company like Nintendo. LOL.

Nintendo will sit on this lawsuit, settling it means a ton of other people can sue, having the judge throw it out of court simply costs the plaintiff more money. Hehehe.

Yet another uninformed chump who doesn't realize that thousands of class action lawsuits are filed every year against big companies all over the world. The lawsuits originate from many other nations besides the US. Also, the only people who make money off of class action lawsuits like this are the lawyers(which are just as greedy everywhere).

a couple of examples of the ludicrous US legal system:
A guy trespasses and dives into the shallow end of someone's pool and injures himself despite a sign warning "Do not dive". He successfully sues the pool manufacturer and wins because the jury was instructed to award damages if the "risk posed by the pool outweighed its utility".
A guy is in a phone booth 15 feet from a street and a drunk driver careens off the road, crosses a parking lot and slams into the booth injuring the occupant. He successfully sues the designer and owner of the phone booth because they should have foreseen the possibility of a car hitting the phone booth "even though "the defendant's conduct may have been without moral blame"

The USA is easily the most litigious society in the world. This is an undisputed fact. It has driven up the prices of everything you buy due to exorbitant liability insurance. It drives obstetricians out of work as it is too risky to delver babies. In some states, women have to drive to a neighboring state to find an obstetrician. It is responsible for 'idiot' labels to be put on everything like "caution, coffee is hot". It estimated that there is at least a $265 billion cost or tax per year on the US economy. Britain, Japan, and Germany all have far fewer lawyers per capita than the U.S.
